Terms of Service

Effective Date: April 1, 2025

Please read these Terms of Service (“Terms”) carefully before using mavinfo.com or any services provided by Mavinfo Corp. (“Mavinfo,” “we,” “our,” or “us”). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to create an account or use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. Account Registration and Security

To access most features, you must register for an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Keep your password confidential and not share it with anyone
Notify us immediately at the contact email in Section 19 if you suspect unauthorized access to your account
Accept responsibility for all activities that occur under your account

Mavinfo reserves the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe have been compromised.

3. Subscriptions, Billing, and Refund Policy

a) Some features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis as selected at the time of purchase.

b) Automatic Renewal: Subscriptions automatically renew at the end of each billing period. You will be charged at the then-current subscription rate unless you cancel before the renewal date.

c) Cancellation: You may cancel your subscription at any time through your account settings. Cancellation is effective immediately and prevents future renewal charges. You will retain full access to your paid subscription features through the end of the billing period for which you have already been charged. Cancellation does not require contacting support — it is self-service through your account dashboard.

d) No Refunds: All subscription fees are final and non-refundable. We do not issue refunds or credits for any reason, including but not limited to: partial use of a subscription period, dissatisfaction with AI-generated outputs, technical issues beyond our reasonable control, or account termination resulting from a violation of these Terms. By completing a subscription purchase, you expressly waive any right to a chargeback or refund except as strictly required by applicable law.

e) We reserve the right to change subscription pricing upon reasonable notice. Price changes take effect at your next renewal date.

4. Prohibited Content and Acceptable Use

The Service is intended for lawful, professional, and personal use. The following are strictly prohibited. Violation of any prohibition in this Section constitutes grounds for immediate account termination under Section 15.

a) Sexually Explicit and Pornographic Content — The upload, processing, generation, or transmission of pornographic, sexually explicit, or sexually suggestive content of any kind is strictly prohibited. This prohibition is absolute and applies regardless of the claimed artistic, educational, or personal nature of the material. This includes but is not limited to: adult content, nudity intended for sexual purposes, sexual acts, and any content that sexualizes real or fictional individuals. Mavinfo has zero tolerance for violations of this provision.

b) Obscene, Vulgar, and Degrading Content — You may not use the Service to upload, process, or generate content that is obscene, grossly vulgar, gratuitously violent, or that a reasonable person would find deeply offensive and without legitimate purpose. This includes material designed to harass, degrade, or dehumanize any individual or group.

c) Illegal Content — You may not use the Service to upload, process, store, or distribute any content that is illegal under applicable federal, state, or local law, including but not limited to: child sexual abuse material (CSAM), content that facilitates criminal activity, material that infringes third-party intellectual property rights, or content that violates any individual's privacy or publicity rights.

d) General Prohibited Uses — You also agree not to:

Upload images of real individuals without their knowledge and consent
Use the Service to harass, threaten, stalk, or intimidate any person
Attempt to circumvent usage limits, account restrictions, or technical safeguards
Use automated bots or scripts to abuse or overload the Service
Attempt to reverse engineer, decompile, or extract source code from the Service
Use the Service to develop a competing product
Transmit malware, viruses, or other harmful code
Misrepresent your identity or impersonate any person or entity

5. Abuse Enforcement and Consequences

Mavinfo actively monitors the Service for violations of these Terms. When a violation is detected or credibly reported, we will act swiftly and without notice.

Abuse of the Service — including but not limited to uploading prohibited content, attempting to circumvent restrictions, or engaging in any activity that violates these Terms — will result in the following consequences, applied immediately and without prior warning:

Immediate and permanent termination of the offending account
Forfeiture of any remaining subscription period — no refund will be issued under any circumstances
Permanent ban from creating new accounts on the Service
Preservation and disclosure of all relevant account data, uploaded content, usage logs, and identifying information to law enforcement authorities if the violation involves or may involve criminal conduct

If your use of the Service violates any applicable federal, state, or local law — including laws pertaining to obscenity, child exploitation, copyright infringement, fraud, harassment, or unauthorized computer access — Mavinfo will report the violation and cooperate fully with law enforcement agencies, including providing all available identifying information, IP logs, uploaded content, and account records without requiring a subpoena where permitted by law.

The decision to terminate an account, issue a ban, or contact law enforcement is made at Mavinfo's sole and absolute discretion. We are not obligated to provide notice, explanation, or an opportunity to cure before taking any of these actions.

6. Content You Submit — Ownership and License

You retain full ownership of all images, files, and other content you upload to the Service (“Your Content”). By submitting content, you grant Mavinfo a limited, non-exclusive, royalty-free license to process and store Your Content solely as necessary to provide the Service to you.

You represent and warrant that: (i) you own Your Content or have the necessary rights and permissions to submit it; (ii) Your Content does not violate any third party's intellectual property rights, privacy rights, or any applicable law; and (iii) you have obtained any necessary consents for images containing other individuals.

We do not claim ownership of Your Content. We do not use Your Content to train AI models without your explicit consent.

7. AI-Generated Outputs — Disclaimer

The Service uses artificial intelligence to process and transform images and generate other outputs (“AI Outputs”). You acknowledge and agree that:

AI Outputs are generated algorithmically and may contain errors, artifacts, or unintended results
AI Outputs are provided “as is” without warranty of any kind
Mavinfo does not guarantee the accuracy, quality, or fitness of AI Outputs for any particular purpose
You are solely responsible for reviewing AI Outputs before using them in any professional, commercial, or other context
Ownership of AI Outputs may be subject to evolving legal frameworks; you are responsible for determining whether AI-assisted works are protectable under applicable law

8. Mavinfo Intellectual Property

The Service, including its software, design, text, graphics, and all other content provided by Mavinfo (excluding Your Content), is the property of Mavinfo Corp. or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Mavinfo content without our express written permission.

9. Usage Limits

Subscription tiers include monthly limits on AI processing jobs, API calls, and other resources as described on the applicable subscription page. Exceeding these limits may result in requests being queued, throttled, or declined until the next billing period. We reserve the right to adjust tier limits with reasonable notice.

10. Availability and Service Changes

We strive to provide reliable access to the Service but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any feature or the entire Service at any time, with or without notice. We will make reasonable efforts to provide advance notice of material changes.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Mavinfo does not warrant that the Service will meet your requirements or that it will be uninterrupted, timely, secure, or error-free.

12. Limitation of Liability and No Responsibility for Data Loss

To the maximum extent permitted by applicable law, Mavinfo and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of data, files, images, or other content — whether uploaded, processed, or stored through the Service
Loss of profits, revenue, or business opportunities
Loss of goodwill or reputation
Costs of substitute services or technology
Any damages resulting from third-party AI model outputs

This applies regardless of the cause of action or the theory of liability, even if Mavinfo has been advised of the possibility of such damages.

In no event shall Mavinfo's total cumulative liability to you for all claims relating to the Service exceed one hundred U.S. dollars ($100.00).

You are solely responsible for maintaining independent backups of any data or content you upload to the Service. Mavinfo expressly disclaims all responsibility for any loss, corruption, or unavailability of your data.

13. Indemnification

You agree to indemnify, defend, and hold harmless Mavinfo and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use of the Service; (ii) Your Content; (iii) your violation of these Terms; or (iv) your violation of any third party's rights.

14. DMCA — Copyright Infringement

We respect intellectual property rights. If you believe that content on our Service infringes your copyright, please submit a written notice to our designated agent at the contact email in Section 19 with the following information: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the allegedly infringing material and its location; (c) your contact information; (d) a statement of good faith belief; and (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.

15. Account Termination

a) By You: You may delete your account at any time through your account settings. Upon deletion, your access to the Service will terminate and we will process data deletion as described in our Privacy Policy. Deletion of your account does not entitle you to any refund of subscription fees.

b) By Mavinfo: We reserve the right to suspend or terminate your account immediately and without notice if we reasonably believe you have violated these Terms, particularly Section 4 (Prohibited Content) or Section 5 (Abuse Enforcement). We may also terminate accounts for any other reason at our sole discretion. Upon termination for cause, you forfeit all remaining subscription value and no refund will be issued.

Sections 6, 7, 8, 11, 12, 13, 17, and 18 survive termination of these Terms.

16. Third-Party Links and Services

The Service may contain links to third-party websites or integrate with third-party services. These are provided for convenience only. Mavinfo does not control, endorse, or accept responsibility for any third-party content, privacy practices, or terms. Your interactions with third-party services are governed solely by their terms and policies.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in Florida, and you hereby consent to the personal jurisdiction of such courts.

18. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service, the parties agree to first attempt to resolve the dispute informally by contacting Mavinfo in writing. If the dispute is not resolved within 30 days, it shall be submitted to binding arbitration administered in Florida in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction in Florida to prevent irreparable harm.

You waive any right to a jury trial and to participate in a class action lawsuit or class-wide arbitration.

20. Modifications to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

21. Entire Agreement

These Terms, together with our Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and Mavinfo with respect to the Service and supersede all prior agreements and representations.

22. Severability and Waiver

If any provision of these Terms is found unenforceable, it shall be modified to the minimum extent necessary and the remaining provisions shall continue in full force. No failure to enforce any provision shall constitute a waiver of that or any other provision.
